PRANK PASS, INC., TERMS OF SERVICE

Please read these Terms of Service (“Terms”) carefully. By accessing or using the Prank Pass website or services, you agree to be legally bound by them.

If you do not agree, please do not use the site. (No hard feelings—but no access either.)

  1. Who We Are and Who You Are

“Prank Pass,” “we,” “us,” or “our” means Prank Pass, Inc. and its affiliated entities, employees, contractors, and service providers.
“You” or “your” means any individual or entity that visits the website, places an order, or uses our services.

“Products” means prank, novelty, letter, video, or related items offered through our website.

“Services” means processing and sending Products at your direction.

“Recipient” means the person or entity you choose to receive a Product.

  1. Eligibility and Acceptance

You must be at least 21 years old to use Prank Pass. This is a company policy, not a comment on your maturity.

By using the website or placing an order, you confirm that:

You meet the age requirement

You have the legal capacity to enter into this Agreement

You understand that this is a binding contract

  1. What Prank Pass Does (and Does Not Do)

Prank Pass is a remailing and fulfillment service. We send items you select, to recipients you choose. Plain meaning, Prank Pass is an on-line wholesale and retail store service featuring products relating to the viewing and carrying out of pranks and practical jokes.

We do not:

Decide who receives Products

Approve or endorse your content

Control how a Product is interpreted or received

In short: we send it, you own it.

  1. Entertainment Use Only

You agree to use Prank Pass solely for lawful, non-malicious entertainment purposes.

You may not use our Products or Services to:

Harass, threaten, intimidate, or harm

Defame or invade privacy

Violate any law, court order, or legal restriction

Target vulnerable individuals or protected groups

Engage in hate speech or discrimination

If a reasonable person would think, “This is a bad idea,” it probably is.

  1. Responsibility for Recipients

You are solely responsible for deciding whether a Product is appropriate for a Recipient.

This includes considering:

Age, health, and emotional state

Cultural or personal sensitivities

How the delivery might reasonably be perceived

Pranks are subjective. Responsibility is not.

  1. Orders, Delivery, and Cancellations

We do not guarantee delivery due to factors beyond our control (addresses, carriers, weather, global events, etc.).

Proof of mailing may be provided upon request.

If we fail to send a Product, your sole remedy is a refund of the amount paid.

Orders cannot be canceled once placed, except at our discretion.
Approved cancellations incur a $6.00 processing fee.

  1. No Warranties; Limited Liability

Products and Services are provided “as is” and “as available.”

To the maximum extent permitted by law:

We disclaim all warranties, express or implied

We are not responsible for recipient reactions, misunderstandings, or consequences

We are not liable for indirect, incidental, or consequential damages

Nothing in these Terms limits liability that cannot legally be limited in your jurisdiction.

  1. Your Devices, Security, and Online Risks

You are responsible for maintaining your own devices, software, and security.

We are not responsible for:

Viruses, malware, or data loss

Third-party breaches or phishing attacks

What happens outside our website

The internet can be a prank too—protect yourself accordingly.

  1. Intellectual Property (Ours, Not Yours)

All website content, branding, text, images, videos, and materials are owned by or licensed to Prank Pass.

You may not copy, reuse, or exploit them without permission.
Unauthorized use may result in legal action and damages as permitted by law.

  1. Indemnification (Fair, Not Overreaching)

You agree to indemnify and hold Prank Pass harmless from claims arising out of:

Content you provide

Recipients you select

Your misuse of the Products or Services

Your violation of these Terms or applicable law

This does not apply to harm caused solely by our intentional misconduct or where prohibited by law.

  1. Privacy and Data Disclosure

Our Privacy Policy explains how we handle personal information.

We may disclose your information if:

Required by law, court order, or arbitration

Necessary to respond to legal claims

Requested by lawful authorities

Disclosure will be limited to what is legally required.

  1. Payments and Third Parties

Payment processing is handled by third-party providers with their own privacy and security practices.

We do not store full payment credentials.
You may request the identity of payment providers by contacting us.

  1. Arbitration and Dispute Resolution

Where legally permitted, disputes will be resolved by binding arbitration on an individual basis, not class actions.

However:

This does not override mandatory consumer rights

If arbitration is unenforceable in your jurisdiction, disputes may proceed in court

Courts may be used to enforce or interpret arbitration decisions

No jury trial where lawful to waive.

  1. Governing Law

This Agreement is governed by the laws of Georgia, USA, unless mandatory local consumer law requires otherwise.

  1. Changes to Services or Terms

We may update Products, Services, prices, or these Terms from time to time.

Continued use after updates means acceptance of the revised Terms.

  1. Termination and Survival

We may suspend or restrict access for violations of these Terms.

Key provisions (liability, arbitration, IP, indemnity) survive termination—because consequences don’t vanish just because access does.

  1. Entire Agreement

These Terms represent the entire agreement between you and Prank Pass regarding use of the website and Services.

Final Note (Yes, This Is the Humor)

Prank Pass exists to make people laugh—not lawyers.
But when lawyers are involved, these Terms apply.
