PRANK PASS, INC. – JURISDICTION-SPECIFIC ADDENDUM

This Addendum supplements the Prank Pass, Inc. Terms of Service and/or API Terms of Service for users, developers, and businesses operating under the laws of the European Union (EU), United Kingdom (UK), Canada (CA), and Australia (AU). It is designed to ensure compliance with local legal requirements without diminishing the binding effect of the main Terms.

1. European Union (EU)

Data Protection (GDPR Compliance)

Personal data of EU users must be processed in compliance with the General Data Protection Regulation (GDPR).

You agree to obtain any necessary consent from recipients before using personal data via our services or API.

Users have the right to access, correct, or request deletion of their personal data; we will assist reasonably.

Consumer Rights

EU consumers retain rights under EU law, including the right to withdraw from certain purchases within 14 days, except where a product is personalized, per EU consumer law exemptions.

Refunds will be handled in accordance with EU consumer protections.

Liability Limitation

Our liability is limited to the maximum extent allowed under EU law.

Nothing in the main Terms excludes or limits liability for death or personal injury caused by our negligence.

2. United Kingdom (UK)

Data Protection (UK GDPR & Data Protection Act 2018)

UK users’ personal data will be processed according to UK GDPR requirements.

You must ensure all recipient data collected or transmitted via our services complies with UK data privacy obligations.

Consumer Rights

UK users retain statutory rights under the Consumer Rights Act 2015, including remedies for faulty services and products.

Refunds, returns, or replacements will comply with these rights.

Governing Law & Venue

UK users agree that English law governs disputes arising under these Terms, subject to mandatory statutory protections.

Arbitration provisions in Section VI do not override UK consumer law that cannot be waived.

3. Canada (CA)

Privacy & Anti-Spam Compliance (PIPEDA & CASL)

Canadian users’ personal data is subject to the Personal Information Protection and Electronic Documents Act (PIPEDA).

You must obtain consent before sending any communications to recipients via our services or API, including complying with the Canadian Anti-Spam Legislation (CASL).

Consumer Protections

Canadian users retain rights under federal and provincial consumer protection laws, including remedies for misrepresentation, defective products, or unfair practices.

Liability and Indemnification

Indemnification clauses remain enforceable, but Canadian law may limit liability exclusions for personal injury, fraud, or statutory rights.

4. Australia (AU)

Privacy Compliance (Privacy Act 1988)

Australian users’ data will be handled in compliance with the Australian Privacy Principles (APPs).

You are responsible for ensuring recipients’ consent where required under Australian law.

Consumer Guarantees

Australian consumers retain rights under the Australian Consumer Law (ACL), including guarantees on acceptable quality and fitness for purpose.

Our limitation of liability does not override these statutory guarantees.

Dispute Resolution

Arbitration provisions may be modified to comply with mandatory Australian consumer protection rights.

We will cooperate with regulatory authorities as required by Australian law.

5. General Provisions for All Jurisdictions

No Waiver of Mandatory Local Law

Nothing in this Addendum or the main Terms of Service overrides local statutory rights that cannot be
waived, including consumer, data protection, or privacy law.

Local Enforcement

You acknowledge that local courts and regulatory authorities may have jurisdiction over claims arising under mandatory law.

All other provisions of the Terms remain fully enforceable to the extent permitted by local law.

Humor Clause (Because Life’s Short)

We promise the services are meant to be funny, not harmful. But we cannot control the recipient’s sense of humor. Users in all jurisdictions agree that “laugh responsibly” is good advice.
